Also please note that PAYROLL USA is only to be distributed by those
distributors who prominently describe the term "ShareWare" in writing in their
catalogs, or for CD-ROM or rack sales, on their package, with a written
statement saying shareware is not free software and encouraging Registration
after a 30 or 60 day evaluation period. The maximum copying fee that may be
charged for PAYROLL USA is $20.00 (for the set of 2 disks) and we prefer you
charge much less than this maximum.
Distributor members of the Association of ShareWare Professionals qualify as
PAYROLL USA distributors. Others also qualify if they meet our standards
described above. Distributors who did not receive these disks direct from us
at Anthistle Systems & Programming Ltd. should advise us so we can add you to
our mailing list for updates.
If you are in the business of misleading your customers into believing they
have full rights to use this software by paying your copying fee then you are
denied permission to distribute PAYROLL USA. This can be inferred if you do
not have the required statement encouraging Registration in your catalog, or
for CD-ROM or rack sales, on your package.
CD-ROM

Other shareware authors report disappointing registrations from programs
distributed on CD-ROM (which is probably not surprising when you consider the
number of programs that can be stored on a CD-ROM and the time it takes a user
to discover a particular program is on it and find the time to try that one
ahead of others). There are also disturbing stories being heard of certain
CD-ROM publishers marketing grab bags of shareware on CD-ROM without even
bothering to ask permission from the authors of those programs, and with no
concern about whether or not the author makes any money - all they care about
is lining their own pockets. The question of whether or not authors should
receive a royalty from sales of CD-ROM's has still to be decided.
It makes good business sense for a responsible CD-ROM publisher to maintain
contact with the authors whose works he wishes to publish and profit from to
ensure the author is happy and the publisher receives updated versions as they
are released. This is a relatively new distribution method for us and so far
the only CD-ROM publisher to keep in touch with us on a regular basis and
provide free samples of his products is Bud Jay of JCS Marketing Inc.,
P.O. Box 1216, Lakeville, MN 55044, Telephone 612-469-5898 (publisher of
"JCSM Shareware Collection" trademarked CD-ROM).
Other CD-ROM publishers wishing to carry our products must:
1. ask permission from us FIRST (we would like to see a sample of your
packaging and proposed disk artwork, or at least the wording of it, and a note
of the proposed pricing, expected distribution quantity, and likely target
market)
2. prominently describe the term "ShareWare" in writing on their packaging
with a written statement saying shareware is not free software and encouraging
Registration after a 30 or 60 day evaluation period,
3. follow up after permission is granted and publication is initiated by
providing us with a free copy of the CD-ROM on which our product appears.
Permission will only be granted on a non-exclusive basis and subject to being
modified by being unconditionally withdrawn at any time and/or by being
withdrawn if the CD-ROM publisher is unwilling to pay royalties from the
date of any notice from us to the publisher's last known address requesting
such royalties.
CD-ROM publication in violation of the above constitutes a violation of our
copyright and may result in legal action either from us alone or as part of a
class action brought by a group of authors (for those of you who do not know,
we authors, ASP members or not, do keep in touch with each other).
RACK SALES
==========
Many rack sales operators actually want their customers to believe they are
buying the program at the rack price. In reality, the disks the program
happens to be on, with an opportunity to evaluate that program, is all they
are buying off the rack. A line of tiny type buried somewhere on the back of
the package does not count as it is unlikely to be read before purchase of the
package. The fact that the program is to be used for evaluation purposes only
must be PROMINENTLY displayed on the package.
We do not consider this to be a problem for CD-ROM sales because the customer
did not buy the CD-ROM for any one specific program, but because Federal
payroll taxes can change each year this product may not be suitable for rack
sales where copies can sit on store shelves or in warehouses for extended
periods - we do not want your irate customers on the phone to us saying they
bought this software at the XYZ Video Store or at the ABC Book Store for $9.99
and demanding a replacement or refund because taxes are out of date and they
thought they had bought lifetime use of this program for their $9.99 (or
$4.99, or whatever), and no they do not want to pay an additional $150 or so
to Register. Because they did not know what they were buying they assume we
were part of your scam (a harsh word, but that is what it amounts to if your
customer does not know what they are buying, and if your operation is run to
make money parasitically on the backs of shareware authors) - it does not do
our image any good and wastes our time, so please do not do it or you risk us
taking legal action against you for damages.
All rack sales must be pre-authorized in writing by us and we need to see a
sample of your packaging before approval is given. Royalties for rack sales
are now a well established practice so be sure to specify what royalty rate
you propose to pay.
